    Hi All,

I will be taking CLEP Intro to Business Law tomorrow morning at 10am.

I would appreciate it if you would pray for me, think of me, light a candle for me, or anything else you can think of.

I have enjoyed studying for this exam. There seems to be a lot of overlap with exams I have taken previously, such as:

    Ethics in America
    Environment & Humanity
    Human Resources
    American Government
    Criminal Justice

As a result, I was already familiar with a LOT of the terminology, legislative acts, court cases, etc.

Of course, I haven't taken the exam yet....so stay tuned to see how helpful those other exams are in preparation for this one!

I found a fantastic web site that provides great lecture notes on all the topics listed in the Factsheet. There are 52 chapters, but obviously you only need some of those for this "Intro" exam. I'm sure the rest will be helpful for DANTES Business Law II though.

Use it if you need it....

    http://myphlip1.pearsoncmg.com/phlip/mplistres5.cfm?vbookid=482
(Click on "Lecture Notes" for each chapter).

I'll let you know how I do tomorrow and hopefully give you a thorough report on the exam,

    Hi All,

Just got back! I passed with a 74.

Personally, I would group this exam in with the "easiest" of the CLEPs. I really don't need to provide a detailed report on this exam. It is enough to say that Instancert is enough to pass it.

If you study Instantcert, you will not have any trouble on this one. It was very straightforward. All the topics mentioned on the CLEP factsheet were covered on the exam. It was very accurate.

I would also highly recommend that you read through the first 24 chapters of the site I provided in my post above. It fills in a few of the gaps in Instantcert, and re-inforces the material.

I finished this 100-question exam with 20 minutes to spare. Don't be afraid of this one at all....seriously!

I have to leave for a bit, and I may write some more specific details later. But honestly, there isn't much else to say other than "study Instantcert".

Thanks for your support as always,
    Snazzlefrag

    Okay,

Here are some specific details about the version of the exam I took.

If you can go down the following list and check off that you have covered each item, you will not fail this exam:

    LAW VIEWS:
(not very much on the exam)

    Analytical View
    Command View
    Critical View
    Historical View
    Law & Economics View
    Legal Realism
    Natural Law View
    Sociological View
    Traditional View

    ETHICS:
(not very much on the exam)

    Utilitarianism (Bentham/Mill)
    Kantian Ethics (Duty)
    Ethical Fundamentalism
    Ethical Relativism
    Maximising Profits Theory
    Corporate Citizenship Theory
    Moral Minimum Theory
    Social Justice Theory (Rawl)
    Stakeholder Interest Theory

    CONTRACT LAW:

Elements of a Contract: Consideration, Capacity, Agreement, Legality
Types of Contract: Implied-in-fact, Implied-in-law (quasi), Express
    Unilateral vs. Bilateral
    Executory Contract vs. Executed Contract
    Liquidated Damages
    Forbearance
    Novation
    Rescission
    Assigned Rights vs. Delegated Duties
    Creditor Beneficiaries vs. Donee Beneficiaries
Exceptions to Consideration: Moral Obligation, Duty, Past Consideration, Illusory Promise
Mutual Mistake vs. Unilateral Mistake (definition and consequences)
Statute of Frauds (what it is and what it covers).
Discharge of a Contract: Void, Voidable, Unenforceable

CONSTITUTIONAL LAW & THE U.S. COURT SYSTEM:
(not very much on the exam)

    Commerce Clause
Bill of Rights (I had a question on the 1st and 2nd Amendments specifically)
    Civil vs. Criminal (procedures/crimes/court system)
    ANTITRUST LAW:
(not very much on the exam)
    Sherman Act
    Clayton Act
    Patman-Robinson Act
    Federal Trade Commission
    Restraint on Trade
Primary, Secondary, and Tertiary Line Injuries
    TORT LAW:
    Intentional Tort vs. Negligent Tort
    Slander vs. Libel
    Assault versus Battery
Proximate Cause vs. Cause in Fact
    Negligence Per Se
    Res Ipsa Loquitur
    Tort
    Strict Liability
    Warranty of Title
    Copyright vs. trademark

    EMPLOYMENT LAW:
(not very much on the exam)

    Fiduciary relationships
    Agency
    Fair Labor Standards Act
    Bakke v University of California
    FMLA
    EEOC
Consolidated Omnibus Budget Reconciliation Act (COBRA)
Civil Rights Act - Title VII (What is covered and what isn't)
    Disparate Treatment
    Disparate Impact

    ENVIRONMENTAL LAW:
(not very much on the exam)

Comprehensive Environmental Response, Compensation & Liability Act (CERCLA/Superfund)
    Clean Air Act
    Clean Water Act
    EPA
    Endangered Species Act

    MISCELLANEOUS:
(passing familiarity will suffice for everything not listed above)

    - Study all of Instantcert
    - Read chapters 1-24 of this site (only one page per chapter):

    http://myphliputil.pearsoncmg.com/st..._5/lec_01.html
(manually change "01.html" to "02.html" etc.)

There is no need to stress out over this exam. Familiarize yourself with the various terms mentioned above and then go and pass it.

    I hope this helps!
