Intro to business law. Hard or easy?

There were a lot of scenarios on my exam, but I don't remember one secifically on forging. I'm horrible about remembering specifics from tests, but I did post some on the test feedback area.

There were a couple of questions about the SEC. It's not something that you need to stress about - but you might Wikepdia it. You also need to understand what makes a contract valid - and who can walk away from it, etc. For example, if a minor enters a contract, and continues to make payments for 2 months after turning 18, he can't walk away from it because he ratified it by continuing to make payments for 2 months.

I know several people that are very smart, and do well on most tests - but you give them a scenario and they panic. Remember to stay calm and breath. Read the scenario, then the question. As you read the answers one may jump out as "that's it!". If there's not, eliminate any obvious bad answers, and re-read the scenarios. Just think through the answers, and you'll do fine.

Thank you so much for your encourage! I will let you guys know how will I make on Monday. I really want to get over it. After the test , I am heading to Huston next day. So I really hope that I can pass then I can enjoy my trip.

Hope you do well on your business law exam. I recommend checking your local library or book store for the "Sum & Substance" series of law lectures on cassette tape or CD. Each set covers a specific area of law, such as tort, contract, criminal, etc., and has about 5-8 hours of material. If you listen to the contract and tort S&S CDs a few times, you should be good to write your exam.

You should be sure to pay special attention to the following, even if only from reading about them on Wikipedia:

-Negotiable instruments
-Offer, acceptance, consideration, and revocation
-The elements of a contract
-Article II of the Uniform Commercial Code
-When a legal incapacity exists to enter into contracts
-The rules applying to offer, acceptance, and revocation as they relate to communication through mail
-The Statute of Frauds
-Promissory estoppel
-Surety
-The difference between unilateral and bilateral contracts
-Things which may void a contract, such as fraud, duress, illegality, impossibility of performance
-Difference between requirements for private sale of goods and vendors' sale of goods (caveat emptor vs. requirement that goods be merchantable)
-Warranties and guarantees
-Tort law, including definition of assault, battery, trespassing, liability for nuisances, etc.

My weakest part is constitutional law and legal systems and procedures.
Since I am running out of time, I think I will just review the three peterson tests as well as reading REA.


I always thought that I understand the terms but whenever I got into the questions, I am lost.

I wouldn't focus too much on constitutional law. The key is to know the relevant rules associated with common law as far as it relates to contracts and torts, and apply them to practical situations. This is business law, so the majority of questions are about those things most commonly affecting business, i.e., contracts and torts.

If I recall correctly (I took the exam a little more than a year ago), there wasn't much constitutional law in comparison to contracts and torts, and practical examples. Just know the Bill of Rights (and the rest of the amendments if you have time), significance of the interstate commerce clause, separation of powers, and the fact that powers not mentioned specifically as being federal in the Constitution are considered to fall under the jurisdiction of the state legislatures.

I have a Canadian legal education background, and the most I have ever been instructed in about U.S. constitutional law was when I took American History in high school. And I hadn't even heard of the Uniform Commercial Code until I took the exam! I still managed to get a 67 on the CLEP Business Law exam, though, because it’s the English common law principles about torts and contracts where the bulk of the marks reside.

This site offers a good, free review: lawschoolhelp.com . Focus on the “Contracts” and “Torts” first, and then move on to "Remedies." If you have time, skim the "Civil Procedure" part, although that's not as important for the exam. The "Legal Research" needn't be read.

Also, try to remember the meanings of some these key Latin terms, as they’re easy to memorize and they’ll get you easy marks on the exam when they ask for the meaning (and they do ask you about at least some of these definitions): Stare decisis, habeas corpus, de jure, de facto, quid pro quo, ex post facto, obiter dictum, ratio decidendi, ultra vires, intra vires, mens rea, actus reus.

American Government. I read the feedback on this test. Most people think it is a very hard test which kinda scare me off. But I think if I study hard, it will pay off. haha. My test schedule on 10th of Jan, right before Spring class start.
