Jen has good points, but I personally will always fight things that are wrong. Not because it will make much difference to me, but what about another student that isn't doing so well? Sure, maybe they're borderline passing, but an unfair test/teacher/etc shouldn't cause them to fail. Not everyone can be geniuses like us!
Go to the Dean (Students or Academic Affairs) and explain what's going on. Get as many other students as you can, in my experience when half a class is making the same statements, they tend to listen.
